Musannaf Ibn Abi Shayba 13:2883

Abu Bakr narrated to us, he said: Ibn Abi Za’idah narrated to us, from Ibn ‘Awn, from Muhammad, that he said to Shurayh: "My guarantor has intervened regarding it, and my wealth has been claimed as a specified amount, and the wealth of my debtor was divided without me." He said: "If he was given a choice, then the guarantor is the debtor. If it was your wealth that was claimed as a specified amount, then you are more entitled to it. And if it was the wealth of your debtor that was divided without you, then it is by shares."
