Musannaf Ibn Abi Shayba 13:2972

Abu Bakr narrated to us, he said: Humayd ibn Abd al-Rahman narrated to us, from al-Hasan, from Mutarrif, regarding the ruling on a man who pledges a collateral, then its owner dies and leaves no wealth other than the collateral, while he has debts other than the debt of the holder of the collateral. He said: The holder of the collateral has more right to the collateral than the creditors of the deceased.
