Musannaf Ibn Abi Shayba 13:2973

Abu Bakr narrated to us, he said: Ibn Idris narrated to us, from Hisham, from al-Hasan, who said: "Indeed, the pledged item (al-rahn) that has been taken into possession, if its owner dies or becomes bankrupt, then the one in whose hand it is, is more entitled to it. But if it has not been taken into possession, then it is among the creditors."
