Musannaf Ibn Abi Shayba 13:3145

Abu Bakr narrated to us, he said: Abd al-Samad narrated to us, from Hammad ibn Salamah, from Humayd, from al-Hakam regarding a man who leases his house for ten years, then dies before that: He said, "The lease is annulled, and the loan (ariyah) is voided." Makhul said, "The loan continues, and the lease is voided." Iyas ibn Mu'awiyah said, "Both continue until their term ends." Ayyub said, from Muhammad ibn Sirin, "They only inherit from that what he owned during his lifetime."
