Musannaf Ibn Abi Shayba 13:3316

Abu Bakr narrated to us, he said: Jarir narrated to us, from Mughira, from Hammad, regarding a man who bought goods from a man, then went to bring a porter to transport them, but found that the owner had sold them [to someone else]. He said: If he finds the specific item, he takes it. But if it has gone and he cannot obtain it, then he has nothing, and the profit [from the second sale] belongs to the one who sold it.
