Musannaf Ibn Abi Shayba 13:543

Abu Bakr narrated to us, he said: Ibn Abi Za'idah narrated to us, from 'Abd al-Malik, from 'Ata', regarding a man who wants a man to sell [something] that he does not possess: If they agree upon the price, then he buys it, he said: He should not buy it except upon an agreement from its owner.
