Musannaf Ibn Abi Shayba 13:681

Abu Bakr narrated to us, he said: Ali ibn Mushir narrated to us, from al-Shaybani, from al-Sha’bi, from ‘Amr ibn Hurayth, that a man bought a slave girl for sixty dinars. He paid thirty [dinars] in cash, and the seller held her as a pledge for the remainder. He remained for some days, then the buyer came with the [rest of the] price, but he found that she had died. He [‘Amr ibn Hurayth] said: "Whatever the seller has taken is his, and as for the remainder, it belongs to the buyer."
