Musannaf Ibn Abi Shayba 13:808

Abu Bakr narrated to us, he said: Ibn ‘Ulayyah narrated to us, from Khalid al-Hadhdha’, that a man bought a house and built upon it. Then a man came and claimed it (by right). He (the judge) wrote that the land should be valued and the building should be valued. If he (the claimant) wishes, he may take the building at its value; and if he refuses, he shall surrender the land at its value.
