Hadith 25:105

Narrated to us Abd al-A’la, from Ma’mar, from Ibn Tawus, that a man from the people of Yemen made a bequest. He said, "So-and-so is free, and so-and-so is free," and he did not name [them all]. [He said], "If I die in this illness of mine." Then the man recovered. A dozen or so slaves disputed with him before the judge of the people of al-Jund. He consulted Tawus regarding that. Tawus said, "They are slaves; his intention was only if an event (death) were to befall him."

حدثنا عبد الأعلى عن معمر عن بن طاوس أن رجلا من أهل اليمن اوصى فقال فلان حر وفلان حر ولم يسم إن مت في مرضي هذا فبرأ الرجل فخاصمه بضعة عشر مملوكا على قاضي أهل الجند فشاور في ذلك طاوسا فقال طاوس هم عبيد إنما كانت نيته إن حدث به حدث
