Hadith 25:151
Abu Usama narrated to us, from Awf, who said: I witnessed Hisham ibn Hubayra judge regarding a man who, at the time of his death, bequeathed to a sister of his the equivalent of the share of two of his children. The deceased left behind sons and daughters. The legatee wanted to place herself in the position of a male, but the heirs refused to place her in any position other than that of a female. He (Hisham) judged that she is in her (the female's) position if there are no sons.
حدثنا أبو أسامة عن عوف قال شهدت هشام بن هبيرة قضى في رجل أوصى لأخت له عند موته بمثل نصيب اثنين من ولده وترك الميت بنين وبنات فأرادت الموصى لها أن تجعل نفسها بمنزلة الذكر وأبي الورثة أن يجعلوها إلا بمنزلة الأنثى فقضى أنها بمنزلتها إن لم يكن بنين
