Hadith 25:20
'Abd al-A'la narrated to us, from Yunus, from Hisham, from al-Hasan, that a man made a will, so he called some people and said: "I call you to witness that my slave, so-and-so, if an incident happens to me [i.e., if I die], he is free." They left him, and it was said to him: "You freed so-and-so and left so-and-so, and he had better service." He said: "Bring the witnesses back to me." They did so, and he said: "I have retracted the manumission of so-and-so, and so-and-so [the other one] is my slave; if an incident happens to me, he is free." The man died. The first one said: "I am free," and the other one said: "I am free." They disputed before 'Abd al-Malik ibn Marwan, who rejected the manumission of the first and authorized the manumission of the second.
حدثنا عبد الأعلى عن يونس عن هشام عن الحسن أن رجلا أوصى فدعا ناسا فقال أشهدكم أن غلامي فلانا إن حدث بي حادث فهو حر فخرجوا من عنده فقيل له اعتقت فلانا وتركت فلانا وكان أحسن بلاء فقال ردوا علي البينة ففعلوا فقال رجعت في عتق فلان وأن فلانا لعبده الآخر إن حدث بي حدث فهو حر فمات الرجل فقال الأول أنا حر وقال الآخر أنا حر فاختصما إلى عبد الملك بن مروان فرد عتق الأول وأجاز عتق الآخر
