Hadith 25:266

Jarir narrated to us, from Abd al-Karim ibn Rifa’i, who said: A man died in Rayy and left behind wealth and slaves. He said, "My slave so-and-so is for so-and-so, and my slave so-and-so is for so-and-so," but his bequest did not reach a third [of his estate]. When the slaves were brought to Kufa, some of the heirs' slaves died, but the slaves of the one to whom he had bequeathed did not die. I asked Ibrahim [al-Nakha'i] about it, and he said: "The recipients of the bequest are to be given according to what their companion bequeathed to them."

حدثنا جرير عن عبد الكريم بن رفيع قال توفي رجل بالري وترك مالا ورقيقا فقال عبدي فلان لفلان وعبدي فلان لفلان فلم تبلغ وصيته الثلث فلما أقبل بالرقيق إلى الكوفة مات بعض رقيق الورثة ولم يمت رقيق الذي أوصى لهم فسألت إبراهيم فقال يعطى أصحاب الوصية على ما أوصى به صاحبه
