Hadith 25:271
Yahya ibn Isa narrated to us, from al-A’mash, from Ibrahim, from al-Aswad, who said: A man came to Umar and said to him: "I had a sister who was a prostitute, and she died and left behind a son. Then he (the son) died and left behind a herd of camels." Umar said: "I do not see any lineage between you and him. Go with them and place them among the camels of charity (sadaqah)." He said: So he went to Ibn Mas’ud and mentioned that to him. Abdullah (Ibn Mas’ud) stood up and came to Umar and said: "What are you saying, O Commander of the Faithful?" He (Umar) said: "I do not see any lineage between him and him." He (Ibn Mas’ud) said: "Is he not his maternal uncle and the guardian of his bounty?" He (Umar) said: "What do you see (is the ruling)?" He said: "I see that he is more entitled to his wealth." So Umar returned them to him.
حدثنا يحيى بن عيسى عن الأعمش عن إبراهيم عن الأسود قال جاء رجل إلى عمر فقال له كانت لي أخت بغي فتوفيت وتركت غلاما فمات وترك ذودا من الإبل فقال عمر ما أرى بينك وبينه نسبا أئت بها فاجعلها في إبل الصدقة قال فأتى بن مسعود فذكر ذلك له فقام عبد الله فأتى عمر فقال ما تقول يا أمير المؤمنين قال ما أرى بينه وبينه نسبا فقال أليس هو خاله وولي نعمته فقال ما ترى قال أرى أنه أحق بماله فردها عليه عمر
