Hadith 25:302
Yahya ibn Adam narrated to us, he said: Sinan ibn Harun al-Barjami narrated to us, from Ash'ath, from al-Hasan and Ibn Sirin. They both said regarding a man who bequeathed a third [of his wealth] to his slave: That is [taken] from his neck [i.e., his value]. If the third is more than his price, he is emancipated and the remainder is given to him. If it is less than his price, he is emancipated and he works for them [the heirs] to pay off the remainder. If he bequeathed dirhams to them, then if the heirs wish, they may authorize it, and if they wish, they may not authorize it.
حدثنا يحيى بن آدم قال ثنا سنان بن هارون البرجمي عن أشعث عن الحسن وبن سيرين قالا في رجل أوصى لعبده بالثلث قالا ذلك من رقبته فإن كان الثلث أكثر من ثمنه عتق ودفع إليه ما بقي وإن كان أقل من ثمنه عتق وسعى لهم فيما بقي وإن أوصى لهم بدراهم فإن شاء الورثة أجازوا وإن شاءوا لم يجيزوا
