Hadith 25:307
Yahya ibn Adam narrated to us, from al-Ashja‘i, who heard Sufyan saying regarding a man who bequeathed his third to two men, and one of them is found dead: He said, "It belongs to the other," meaning the entire third. Yahya said, "And it is the [correct] opinion."
حدثنا يحيى بن آدم عن الأشجعي سمع سفيان يقول في رجل أوصى بثلثه لرجلين فيوجد أحدهما ميتا قال يكون للآخر يعني الثلث كله قال يحيى وهو القول
