Hadith 25:310
Abu Usama narrated to us, he said: Waddaḥ narrated to us, from Mughīra, from Ḥammād, regarding a man who died and left three sons, and he said: "A third of my wealth is for my youngest son." The eldest said: "I do not permit it." The middle one said: "I permit it." He (Ḥammād) said: "Place it into nine shares, and take out his third; he shall have his share and the share of the one who permitted it." And Ḥammād said: "The share is returned to all of them." And ‘Āmir said: "The one who refused only refused against himself."
حدثنا أبو أسامة قال ثنا وضاح عن مغيرة عن حماد في رجل توفي وترك ثلاثة بنين وقال ثلث مالي لأصغر بني فقال الأكبر أنا لا أجيز وقال الأوسط أنا أجيز فقال إجعلها على تسعة أسهم يرفع ثلثه فله سهمه وسهم الذي أجازه وقال حماد يرد عليهم السهم جميعا وقال عامر الذي رد إنما رد على نفسه
