Hadith 25:312
Ibn ‘Ulayyah narrated to us, he said: I was with Dawud ibn Abi Hind when two men or more from the family of Anas ibn Malik came, among them ‘Ubayd Allah ibn Abi Bakr. They brought with them a document on a parchment, and they mentioned that it was the will of Anas ibn Malik. I opened it, and its beginning was: "In the name of Allah, the Most Gracious, the Most Merciful. This is a record of what Anas ibn Malik wrote in this parchment regarding the matter of his will. I enjoin those I have left behind of my family to the fear of Allah, gratitude to Him, holding fast to His rope, and belief in His promise. I enjoin them to reconcile their differences, to show mercy to one another, to righteousness, and to piety." Then he bequeathed that one-third of his wealth be charity, unless he changes his will before he joins Allah, except in the way of Allah, if the affair of the nation at that time is unified. And [it is to be spent] on the freeing of slaves and the near relatives, and those whom I have named for manumission from my slaves on the day [of my death]. If manumission reaches them, then the executor of my will shall appraise them from the one-third, without being restricted or disputed.
حدثنا بن علية قال كنت عند داود بن أبي هند فجاء رجلان أو أكثر من آل أنس بن مالك بينهم عبيد الله بن أبي بكر وجاؤوا معهم بكتاب في صحيفة ذكروا أنها وصية أنس بن مالك ففتحت صدرها بسم الله الرحمن الرحيم هذا ذكر ما كتب أنس بن مالك في هذه الصحيفة من أمر وصيته إني أوصي ما تركت من أهلي بتقوى الله وشكره واستمساك بحبله وإيمان بوعده وأوصيهم بصلاح ذات [ البين ] والتراحم والبر والتقوى ثم أوصى من توفي أن ثلث ماله صدقة إلا أن يغير وصيته قبل أن يلحق بالله إلا في سبيل الله إن كان أمر الأمة يومئذ جميعا وفي الرقاب والأقربين ومن سميت له العتق من رقيقي يوم ( 1 ) فأدركه العتق فإنه يقيمه ولي وصيتي في الثلث غير حرج ولا منازع
