Hadith 25:41
Ya'la narrated to us, from Abd al-Malik, from Ata, regarding a man who bequeathed a third of his wealth and things other than that, and left behind a house. [He was asked]: "Should the third of it be given to the one to whom the third was bequeathed?" He said: "No, but he is to be given [his share] by proportion from the wealth and the house."
حدثنا يعلى عن عبد الملك عن عطاء في رجل أوصى بثلث ماله وأشياء سوى ذلك وترك دارا يكون ثلثها أيعطاها الموصى له بالثلث قال لا ولكن يعطى بالحصة من المال والدار
