Hadith 25:68

Al-Dahhak narrated to us, from Ibn Jurayj, from Ibn Tawus, from his father, who said: He did not consider a bequest to be valid except for the relatives who are in poverty. If he bequeathed it to others, it would be taken away from them and returned to them [the relatives]. If there were no poor people among them, then it would go to the poor, whoever they may be, provided that the people entitled to it remain, except for those to whom he bequeaths it.

حدثنا الضحاك عن بن جريج عن بن طاوس عن أبيه قال كان لا يرى الوصية إلا لذوي الأرحام أهل الفقر فإن أوصى بها لغيرهم نزعت منهم فردت إليهم فإن لم يكن فيهم فقراء فلأهل الفقر من كانوا وأن بقي أهلها إلا من يوصي لهم
