Hadith 5:293
Muhammad ibn Bakr narrated to us, from Ibn Jurayj, who said: I said to ‘Ata’, "It (the land) is irrigated by a spring for most of the time, then it requires the well during the dry season to be irrigated by it, then the dry season ends, and it returns to the spring. How is its Zakat (charity)?" He said: "One-tenth (al-‘ushr). And it may be that it is more than that, such that it is irrigated by it. If it is irrigated by the spring more than it is irrigated by the bucket (well), then upon it is one-tenth. And if it is irrigated by the bucket more than it is irrigated by the spring, then upon it is half of one-tenth." I said: "Is it in the same status as that also, if the wealth (crop) is rain-fed or naturally irrigated for most of the time, then it requires the well?" He said: "Yes." Abu al-Zubayr said: And I heard Ibn ‘Umar say this statement. Then I asked Salim ibn ‘Abd Allah, and he said the like of the statement of ‘Abd Allah.
حدثنا محمد بن بكر عن بن جريج قال قلت لعطاء إنما يكون على العين عامة الزمان ثم يحتاج إلى البئر في القطع يسقى بها ثم القطعة ثم يصير إلى العين كيف صدقته قال العشر وقد يكون ذلك على أكثر ذلك أن يسقى به إن كان يسقى بالعين أكثر مما يسقى بالدلو ففيه العشر وان كان يسقى بالدلو أكثر مما يسقى بالعين ففيه نصف العشر قلت هو بمنزلة ذلك أيضا المال يكون بعلا أو عثريا عامة الزمان ثم يحتاج إلى البئر قال نعم قال أبو الزبير وسمعت بن عمر يقول هذا القول ثم سألت سالم بن عبد الله فقال مثل قول عبد الله
