Hadith 5:813

Abu Bakr narrated to us, he said: Abd al-Rahim narrated to us, from Amr ibn Maymun, who said: The governor in the time of Abd al-Malik took twenty thousand from the wealth of a man from the people of al-Raqqah who was called Abu A’isha, and it was entered into the public treasury (Bayt al-Mal). When Umar ibn Abd al-Aziz became the ruler, his children came to him and raised their grievance to him. So he wrote to Maymun: "Pay them their wealth, and take the Zakat for this year of theirs. Were it not that it was 'Dhamar' (lost/unrecoverable) wealth, we would have taken from it the Zakat for what has passed."

حدثنا أبو بكر قال حدثنا عبد الرحيم عن عمرو بن ميمون قال أخذ الوالي في زمن عبد الملك مال رجل من أهل الرقة يقال له أبو عائشة عشرين ألفا فأدخلت في بيت المال فلما ولي عمر بن عبد العزيز أتاه ولده فرفعوا مظلمتهم إليه فكتب إلى ميمون ادفعوا إليهم أموالهم وخذوا زكاة عامه هذا فلولا أنه كان مالا ضمارا أخذنا منه زكاة ما مضى
