Hadith 5:814

Abu Usama narrated to us, from Hisham, from Maymun, that a man lost some wealth in some acts of injustice, and it fell into the public treasury (Bayt al-Mal). When Umar ibn Abd al-Aziz assumed authority, it was brought to his attention. Umar wrote: "Pay it to him, and take from him the Zakat for what has passed." Then he followed them up afterward with a letter: "Pay it to him, then take from him the Zakat for that year only, for it was wealth that was inaccessible (damar)."

حدثنا أبو أسامة عن هشام عن ميمون أن رجلا ذهب له مال في بعض المظالم ووقع في بيت المال فلما ولي عمر بن عبد العزيز رفع إليه فكتب عمر أن ادفعوا إليه وخذوا منه زكاة ما مضى ثم أتبعهم بعد بكتاب أن أدفعوا إليه ثم خذوا منه زكاة ذلك العام فإنه كان مالا ضمارا
