Hadith 5:96
Ali bin Mushir narrated to us, from al-Ajalih, from al-Sha’bi, who said: The Messenger of Allah (may Allah bless him and grant him peace) wrote to Yemen that from camels, for every five, one sheep is to be taken; for every ten, two sheep; for fifteen, three sheep; for twenty, four sheep; and for twenty-five, five sheep. When it increases by one, then in it is a *bint makhad* (a one-year-old female camel) up to thirty-five. If a *bint makhad* is not found among the camels, then an *ibn labun* (a two-year-old male camel) is to be taken. When it increases by one, then in it is a *bint labun* (a two-year-old female camel) up to forty-five. When it increases by one, then in it is a *hiqqah* (a three-year-old female camel) up to sixty. When it increases by one, then in it is a *jadha’ah* (a four-year-old female camel) up to seventy-five. When it increases by one, then in it are two *bint labun* up to ninety. When it increases by one, then in it are two *hiqqah* up to one hundred and twenty. When the camels increase beyond that, then for every fifty there is a *hiqqah*, and for every forty there is a *bint labun*. Neither should that which is combined be separated, nor should that which is separate be combined. And there shall not be taken for *sadaqah* (zakat) a male goat, nor an aged animal, nor one with a defect. Al-Ajalih said: I said to al-Sha’bi, "What does he mean by his saying: 'Neither should that which is separate be combined, nor should that which is combined be separated'?" He said: "A man has sheep, so he does not separate them so that *sadaqah* is not taken from them. And 'not combining that which is separate' means a group of people have sheep in which *zakat* is not obligatory, so they do not combine them so that *sadaqah* is taken from them."
حدثنا علي بن مسهر عن الأجلح عن الشعبي قال كتب رسول الله صلى الله عليه وسلم إلى اليمن أن يؤخذ من الإبل من كل خمس شاة ومن كل عشر شاتان ومن خمسة عشر ثلاث شياه ومن عشرين أربع شياه ومن خمس وعشرين خمس شياه فإذا زادت واحدة ففيها بنت مخاض إلى خمس وثلاثين فإن لم تجد في الإبل بنت مخاض فابن لبون ذكر فإذا زادت واحدة ففيها بنت لبون إلى خمس وأربعين فإن زادت واحدة ففيها حقة إلى ستين فإن زادت واحدة ففيها جذعة إلى خمس وسبعين فإن زادت واحدة ففيها بنتا لبون إلى تسعين فإن زادت واحدة ففيها حقتان إلى عشرين ومائة فإذا كثرت الإبل ففي كل خمسين حقة وفي كل أربعين بنت لبون ولا يفرق بين مجتمع ولا يجمع بين مفترق ولا يؤخذ في الصدقة تيس ولا هرمة ولا ذات عوار قال الأجلح فقلت للشعبي ما يعني بقوله لا يجمع بين مفترق ولا يفرق بين مجتمع قال الرجل تكون له الغنم فلا يفرقها كي لا يؤخذ منها صدقة ولا يجمع بين مفترق القوم تكون لهم الغنم لا تجب فيها الزكاة فلا تجمع فتؤخذ منها الصدقة
