Musnad Abu Bakr al-Siddiq (RA) In the name of Allah, the Most Gracious, the Most Merciful

مسند أبو بكر الصديق رضي الله عنه بسم الله الرحمن الرحيم

Hadith 1:4

Al-Harith ibn Surayj Abu Umar narrated to us, Sufyan ibn Uyaynah narrated to us, Amr narrated to us, from Ibn Shihab, from Malik ibn Aws ibn al-Hadthan, that he narrated to him, saying: Umar sent for me after the day had advanced. I was granted permission, so I entered upon him while he was on a bed of palm fiber, his back leaning against its ropes, reclining on a leather pillow. He said to me: "O Malik, a group of your people has arrived, and I have ordered some wealth for them, so take it and distribute it among them." I said to him: "O Commander of the Faithful, I have no strength for that, so if you would order someone else to do it." He said: "Take it and distribute it among them." He said: Then Yarfa’ came to him and said: "O Commander of the Faithful, do you have any need for Uthman ibn Affan, Abd al-Rahman ibn Awf, al-Zubayr, and Sa’d?" He said: "Yes." So he granted them permission, and they entered. Then he came and said: "O Commander of the Faithful, do you have any need for Ali and al-Abbas?" He said: "Yes." He said: So they entered, and al-Abbas was saying: "O Commander of the Faithful, judge between me and this one." Sufyan said: And he mentioned harsh words. The people said: "O Commander of the Faithful, judge between them and relieve each one of them from the other." Umar said to them: "I adjure you by Allah, by Whose permission the heavens and the earth stand, do you know that the Messenger of Allah (peace and blessings of Allah be upon him) said: 'We are not inherited from; what we leave is charity'?" They said: "Yes." Umar said: "Indeed, Allah singled out His Messenger (peace and blessings of Allah be upon him) with a special matter that He did not single out anyone else with." Then he recited the verse: *'Whatever Allah restored to His Messenger from them—you did not spur for it any horses or camels'* (Al-Hashr: 6). Sufyan said: I do not know if he recited the verse after it or not. He said: "The Messenger of Allah (peace and blessings of Allah be upon him) distributed the wealth of Banu al-Nadir among you. By Allah, he did not prefer himself over you, nor did he withhold it from you. The Messenger of Allah (peace and blessings of Allah be upon him) would take from it his sustenance and the sustenance of his family for his year, and he would place what remained into the horses and weapons as equipment in the way of Allah." Then he said to them: "I adjure you by the One by Whose permission the heaven and the earth stand, do you know that?" They said: "Yes." Then he adjured Ali and al-Abbas with what he had adjured the people: "Do you both know that?" They said: "Yes." He said: "When the Messenger of Allah (peace and blessings of Allah be upon him) passed away, Abu Bakr was the successor of the Messenger of Allah (peace and blessings of Allah be upon him). You came, O Abbas, seeking your inheritance from your brother's son, and Ali came seeking the inheritance of his wife from her father. Abu Bakr said: The Messenger of Allah (peace and blessings of Allah be upon him) said: 'We are not inherited from; what we leave is charity.' You saw me—and Allah knows that he passed away righteous, rightly guided, and following the truth." "Then when Abu Bakr passed away, I said: I am the successor of the Messenger of Allah (peace and blessings of Allah be upon him) and the successor of Abu Bakr. You saw me—and Allah knows that I am truthful, righteous, rightly guided, and following the truth. You both came to me, and your matter was one, and you asked me to hand it over to you. I said: If you wish, I will hand it over to you on the condition that you have the covenant of Allah upon you that you will act therein as the Messenger of Allah (peace and blessings of Allah be upon him) used to act therein. So you took it on that basis." He said to them: "Is it not so?" They said: "Yes." He said: "Then you came to me to judge between you. By Allah, I will not judge between you with anything other than that until the Hour is established. If you are unable, then return it to me."

حدثنا الحارث بن سريج أبو عمر حدثنا سفيان بن عيينة حدثنا عمرو عن بن شهاب عن مالك بن أوس بن الحدثان أنه حدثه قال * أرسل إلي عمر بعد ما متع النهار فأذن لي فدخلت عليه وهو على سرير ليف مسند ظهره إلى رماله متكئ على وسادة من آدم فقال لي يا مالك إنه قد دف دافة من قومك وقد أمرت لهم بمال فخذه فاقسمه بينهم فقلت له يا أمير المؤمنين مالي على ذلك من قوة فلو أمرت به غيري فقال خذه فاقسمه فيهم قال ثم جاءه يرفأ فقال يا أمير المؤمنين هل لك في عثمان بن عفان وعبد الرحمن بن عوف والزبير وسعد قال نعم فأذن لهم فدخلوا ثم جاءه فقال يا أمير المؤمنين هل لك في علي والعباس قال نعم قال فدخلا والعباس يقول يا أمير المؤمنين اقض بيني وبين هذا قال سفيان وذكر كلاما شديدا فقال القوم يا أمير المؤمنين اقض بينهما وأرح كل واحد منهما من صاحبه فقال لهم عمر أنشدكم بالله الذي بإذنه تقوم السماوات والأرض أتعلمون أن رسول الله صلى الله عليه وسلم قال لا نورث ما تركنا صدقة قالوا نعم فقال عمر إن الله خص رسوله صلى الله عليه وسلم بخاصة لم يخص بها أحدا غيره ثم قرأ الآية ما أفاء الله على رسوله منهم فما أوجفتم عليه من خيل ولا ركاب الآية الحشر قال سفيان ولا أدري قرأ الآية التي بعدها أم لا قال فقسم رسول الله صلى الله عليه وسلم بينكم أموال بني النضير فوالله ما استأثر عليكم ولا أحرزها دونكم فكان رسول الله صلى الله عليه وسلم يأخذ منه نفقته ونفقة عياله لسنته ويجعل ما فضل في الكراع والسلاح عدة في سبيل الله ثم قال لهم أنشدكم بالذي بإذنه تقوم السماء والأرض أتعلمون ذلك قالوا نعم ثم نشد عليا والعباس بما نشد القوم به أتعلمان ذلك قالا نعم قال فلما توفي رسول الله صلى الله عليه وسلم كان أبو بكر ولي رسول الله صلى الله عليه وسلم فجئت يا عباس تطلب ميراثك من بن أخيك وجاء علي يطلب ميراث امرأته من أبيها فقال أبو بكر قال رسول الله صلى الله عليه وسلم لا نورث ما تركنا صدقة فرأيتماني والله يعلم أنه مضى بارا راشدا تابعا للحق فلما توفي أبو بكر فقلت أنا ولي رسول الله صلى الله عليه وسلم وولي أبي بكر فرأيتماني والله يعلم أني صادق بار راشد تابع للحق فجئتماني وأمركما واحد فسألتماني أن أدفعها إليكم فقلت إن شئتما دفعتها إليكما على أن عليكما عهد الله أن تعملا فيها بالذي كان يعمل فيها رسول الله صلى الله عليه وسلم فأخذتماها بذلك فقال لهما أكذاك قالا نعم قال ثم جئتماني لأقضي بينكما والله لا أقضي بينكما بغير ذلك حتى تقوم الساعة فإن عجزتما فرداها إلي
