Musnad Abu Ya'la al-Mawsili 3:76

'Ubayd Allah narrated to us, Yazid ibn Zuray' narrated to us, Sufyan narrated to us, from Abu Husayn, from 'Umayr ibn Sa'id, from 'Ali, who said: "I would not establish a prescribed punishment (hadd) upon anyone, such that he dies, and then feel [guilt] within myself, except for the drinker of wine. For if he were to die, I would pay his blood money (diyah), because the Prophet, peace and blessings of Allah be upon him, did not establish it (as a fixed hadd)."
