Musnad Abu Ya'la al-Mawsili 108:56

Abu Bakr narrated to us, Yunus bin Muhammad narrated to us, 'Abd al-Wahid bin Ziyad narrated to us, Mujalid bin Sa'id narrated to us, al-Sha'bi narrated to me, from Jabir: That two women from Hudhayl, one of them killed the other, and each of them had a husband and children. The Messenger of Allah (ﷺ) placed the blood money of the slain woman upon the *'aqilah* (male paternal relatives) of the killer, and he absolved her husband and her children. The *'aqilah* of the slain woman said, "Her inheritance is for us." The Messenger of Allah (ﷺ) said, "No, her inheritance is for her husband and her children." He said: And she was pregnant. The *'aqilah* of the slain woman said, "She was pregnant and she cast out a fetus." He said: The *'aqilah* of the killer feared that they would be held liable for it. They said, "O Messenger of Allah, it did not drink, nor did it eat, nor did it cry out, so it should be liable?" The Messenger of Allah (ﷺ) said, "Is this the rhymed prose of the Jahiliyyah?" And he decreed for the fetus a *ghurrah* (a slave, male or female).
