Hadith 114:1

Muslim ibn Abi Muslim al-Jarmi narrated to us, Makhlad ibn al-Husayn narrated to us, Hisham narrated to us, from Ibn Sirin, from Anas ibn Malik, who said: The first *li'an* (oath of condemnation) in Islam was that Hilal ibn Umayyah accused Sharik ibn Sahma' regarding his wife. It was brought to the Messenger of Allah (peace and blessings of Allah be upon him), and the Prophet (peace and blessings of Allah be upon him) said: "O Hilal, four witnesses, or else a punishment on your back." He said: "O Messenger of Allah, Allah knows that I am truthful, and Allah will surely reveal that which will absolve my back from the flogging." So Allah revealed the verse of *li'an*: "And those who accuse their wives and have no witnesses except themselves..." to the end of the verse in [Surah] an-Nur. The Prophet (peace and blessings of Allah be upon him) called him and said: "Testify by Allah that you are among the truthful regarding what you have accused her of concerning adultery." So he testified to that four times. Then he said to him on the fifth: "And the curse of Allah be upon you if you are among the liars regarding what you have accused her of concerning adultery." So he did so. Then the Messenger of Allah (peace and blessings of Allah be upon him) called her and said: "Stand and testify by Allah that he is among the liars regarding what he has accused you of concerning adultery." So she testified to that four times. Then he said to her on the fifth: "And the wrath of Allah be upon you if he is among the truthful regarding what he has accused you of concerning adultery." Makhlad said: When it was the fourth or fifth [testimony], she paused for a moment until they thought she would confess. Then she said: "I will not disgrace my people for the rest of the day." So she proceeded with the statement. The Messenger of Allah (peace and blessings of Allah be upon him) separated them and said: "Look, if she brings him forth curly-haired, with thin shanks, then he is for Sharik ibn Sahma'. And if she brings him forth white, straight-haired, with moon-like eyes, then he is for Hilal ibn Umayyah." She brought him forth dark-skinned, curly-haired, with thin shanks. The Messenger of Allah (peace and blessings of Allah be upon him) said: "Had it not been for what was revealed regarding them in the Book of Allah, I would have had a matter with her."

حدثنا مسلم بن أبي مسلم الجرمي حدثنا مخلد بن الحسين حدثنا هشام عن بن سيرين عن أنس بن مالك قال * أول لعان كان في الإسلام أن شريك بن سحماء قذفه هلال بن أمية بامرأته فرفعت إلى رسول الله صلى الله عليه وسلم فقال النبي صلى الله عليه وسلم يا هلال أربعة شهود وإلا فحد في ظهرك فقال يا رسول الله إن الله ليعلم إني لصادق ولينزلن الله ما يبرىء به ظهري من الجلد فأنزل الله آية اللعان والذين يرمون أزواجهم ولم يكن لهم شهداء إلا أنفسهم إلى آخر الآية النور فدعاه النبي صلى الله عليه وسلم فقال اشهد بالله إنك لمن الصادقين فيما رميتها به من الزنى فشهد بذلك أربع شهادات ثم قال له في الخامسة ولعنة الله عليك إن كنت من الكاذبين فيما رميتها به من الزنى ففعل ثم دعاها رسول الله صلى الله عليه وسلم فقال قومي اشهدي بالله إنه لمن الكاذبين فيما رماك به من الزنى فشهدت بذلك أربع شهادات ثم قال لها في الخامسة وغضب الله عليك إن كان من الصادقين فيما رماك به من الزنى فقالت قال مخلد فلما كان في الرابعة أو الخامسة سكتت سكتة حتى ظنوا أنها ستعترف ثم قالت لا أفضح قومي سائر اليوم فمضت على القول ففرق رسول الله صلى الله عليه وسلم بينهما وقال انظروا إن جاءت به جعدا حمش الساقين فهو لشريك بن سحماء وإن جاءت به أبيض سبطا أقمر العينين فهو لهلال بن أمية فجاءت به آدم جعدا حمش الساقين فقال رسول الله صلى الله عليه وسلم لولا ما نزل فيهما من كتاب الله كان لي ولها شأن
