Musnad Sa'd ibn Abi Waqqas (RA)

Hadith 6:118

Abu Khaythama narrated to us, Wahb ibn Jarir narrated to us, my father narrated to us, he said: I heard Ya'la from Sulayman ibn Abi Abd Allah, he said: I witnessed Sa'd ibn Abi Waqqas, and a group of people came to him regarding a slave of theirs whom Sa'd had seized his spoils from. He saw him hunting in the sanctuary (Haram) of Medina, which the Messenger of Allah, peace and blessings of Allah be upon him, had declared sacred. So he took his spoils. They spoke to him to return their spoils to them, but he refused and said: "The Messenger of Allah, peace and blessings of Allah be upon him, said when he defined the boundaries of the sanctuary of Medina: 'Whoever you catch hunting within these boundaries, then whoever catches him, his spoils belong to him.' So I will not return to you a provision that the Messenger of Allah, peace and blessings of Allah be upon him, has provided for me. However, if you wish, I will pay you the price of his spoils."

حدثنا أبو خيثمة حدثنا وهب بن جرير حدثنا أبي قال سمعت يعلي عن سليمان بن أبي عبد الله قال * شهدت سعد بن أبي وقاص وأتاه قوم في عبد لهم أخذ سعد سلبه رآه يصيد في حرم المدينة الذي حرم رسول الله صلى الله عليه وسلم فأخذ سلبه فكلموه في أن يرد عليهم سلبه فأبى وقال إن رسول الله صلى الله عليه وسلم قال حين حد حدود حرم المدينة فقال من أخذتموه يصيد في هذه الحدود فمن أخذه فله سلبه فلا أرد عليكم طعمة أطعمنيها رسول الله صلى الله عليه وسلم ولكن إن شئتم غرمت لكم ثمن سلبه
