Musnad Ahmad 27:713

Yahya narrated to us, from Ubaydullah, Nafi’ informed me, from Ibn Umar, from the Prophet (peace and blessings of Allah be upon him), who said: "Whichever date palm tree its roots are sold, then its fruit belongs to the one who pollinated it, unless the buyer stipulates [otherwise]."
