Musnad Ahmad 25:397

'Affan narrated to us, Jarir ibn Hazim informed us, Qays ibn Sa'd informed us, from Yazid ibn Hurmuz, who said: Najdah ibn 'Amir wrote to Ibn 'Abbas asking him about some things. I witnessed Ibn 'Abbas when he read his letter and when he wrote his reply. Ibn 'Abbas said: "By Allah, were it not that I might turn him away from an evil he is falling into, I would not have written to him, nor would I have granted him the favor of an eye." He said: So he wrote to him: "You asked me about the share of the near relatives which Allah, the Almighty and Majestic, mentioned: Who are they? We used to believe that they were the relatives of the Messenger of Allah, may Allah bless him and grant him peace, but our people refused that for us." "And you asked him about the orphan: When does his orphanhood end? It is when he reaches the age of marriage and is perceived to have sound judgment; his wealth is then handed over to him, and his orphanhood has ended." "And you asked him: Did the Messenger of Allah, may Allah bless him and grant him peace, kill any of the children of the polytheists? He said: 'The Messenger of Allah, may Allah bless him and grant him peace, did not kill any of them.' And you, do not kill [them], unless you know what Al-Khidr knew regarding the boy he killed." "And you asked him about the woman and the slave: Do they have a known share if they are present at the battle? They do not have a known share, except that they may be given a gift from the spoils of the Muslims."
