Musnad Ahmad 28:270

Al-Husayn narrated to us, Ibn Abi al-Zinad narrated to me, from Abd al-Rahman—meaning Ibn al-Harith—, Amr ibn Shu’ayb informed me, from his father, from his grandfather: That he heard a man from Muzaynah ask the Messenger of Allah, peace and blessings of Allah be upon him: "What do you say, O Messenger of Allah, regarding stray camels?" The Messenger of Allah, peace and blessings of Allah be upon him, said: "What do you have to do with them? They have their footwear and their water-skin with them." He said: "Then stray sheep?" He said: "They are for you, or for your brother, or for the wolf." He said: "What about one who takes them from their pasture?" He said: "He shall be punished and fined the equivalent of their price. And whoever releases them from their tether, or extracts them from a pen—which are the shelters—then upon him is the cutting [of the hand]." He said: "O Messenger of Allah, what about fruit that is found in its coverings?" The Messenger of Allah, peace and blessings of Allah be upon him, said: "There is no path [of punishment] for one who eats [out of hunger]. Whoever takes a bundle [in his garment], he shall be fined the equivalent of its price and punished. And whoever takes anything from it after it has been brought to the drying yard or breaks a door for it, and what he takes reaches the price of a shield, then upon him is the cutting [of the hand]." He said: "O Messenger of Allah, what about treasure that we find in ruins and in burial mounds?" The Messenger of Allah, peace and blessings of Allah be upon him, said: "In it, and in buried treasure (Rikaz), is one-fifth."
