Hadith 28:458

Yazid narrated to us, Muhammad ibn Ishaq informed us, from ‘Amr ibn Shu‘ayb, from his father, from his grandfather, who said: I heard a man from Muzaynah asking the Prophet, peace and blessings of Allah be upon him—and he mentioned the like of the hadith of Ibn Idris—he said: And he asked him about fruits and what was in their coverings? He said: "Whoever eats with his mouth and does not take a bundle (in his garment), there is nothing upon him. And whoever is found having carried (some away), upon him is its price twice over and a disciplinary punishment. And whatever is taken from the threshing floor, upon it is the cutting (of the hand), if what is taken of that reaches the price of a shield." He said: "O Messenger of Allah, what about what we find on the public road of lost property?" He said: "Make it known for a year; if its owner comes, (give it to him), otherwise it is yours." He said: "O Messenger of Allah, what about what we find in ancient ruins?" He said: "In it, and in buried treasure (Rikaz), is one-fifth."

حدثنا يزيد، أخبرنا محمد بن إسحاق، عن عمرو بن شعيب، عن أبيه، عن جده، قال: سمعت رجلا من مزينة، وهو يسأل النبي صلى الله عليه وسلم - فذكر نحو حديث ابن إدريس -، قال: وسأله عن الثمار وما كان في أكمامه؟ فقال: " من أكل بفمه، ولم يتخذ خبنة فليس عليه شيء، ومن وجد قد احتمل ففيه ثمنه مرتين وضرب نكال، فما أخذ من جرانه، ففيه القطع، إذا بلغ ما يؤخذ من ذلك ثمن المجن "، قال: يا رسول الله، ما نجد في السبيل العامر من اللقطة، قال : " عرفها حولا، فإن جاء صاحبها، وإلا فهي لك "، قال: يا رسول الله، ما نجد في الخرب العادي؟ قال: " فيه وفي الركاز الخمس "
