Hadith 28:564

Hashim ibn al-Qasim narrated to us, Muhammad—meaning Ibn Rashid—narrated to us, from Sulayman—meaning Ibn Musa—from ‘Amr ibn Shu‘ayb, from his father, from his grandfather: That the Messenger of Allah (ﷺ) decreed that every person whose lineage is sought to be established after his father—to whom he is attributed—is claimed by his heirs after him, he decreed: If he was from a slave woman whom he (the father) owned on the day he had intercourse with her, then he is joined to the one who claimed him, and he has no share in the inheritance that was divided before him. As for the inheritance that he caught up with which had not yet been divided, he has his portion. He is not joined if the father to whom he is attributed denied him. If he was from a slave woman whom he did not own, or from a free woman with whom he committed adultery, then he is not joined and he does not inherit, even if the father to whom he is attributed is the one who claimed him. He is a child of adultery for the family of his mother, whoever they may be, whether free or a slave.

حدثنا هاشم بن القاسم، حدثنا محمد يعني ابن راشد، عن سليمان يعني ابن موسى، عن عمرو بن شعيب، عن أبيه، عن جده: أن رسول الله صلى الله عليه وسلم " قضى أن كل مستلحق يستلحق بعد أبيه الذي يدعى له، ادعاه ورثته من بعده، فقضى: إن كان من أمة يملكها يوم أصابها فقد لحق بمن استلحقه، وليس له فيما قسم قبله من الميراث شيء، وما أدرك من ميراث لم يقسم، فله نصيبه، ولا يلحق إذا كان أبوه الذي يدعى له أنكره، وإن كان من أمة لا يملكها، أو من حرة عاهر بها، فإنه لا يلحق ولا يرث، وإن كان أبوه الذي يدعى له هو الذي ادعاه، وهو ولد زنا لأهل أمه، من كانوا، حرة، أو أمة "
