Musnad Ahmad 30:3785

'Uthman ibn 'Umar narrated to us, Yunus informed us, from al-Zuhri, from Sa'id ibn al-Musayyib and Abu Salamah, from Abu Hurayrah, who said: Two women from Hudhayl fought, and one of them threw a stone at the other, killing her and what was in her womb. They disputed before the Messenger of Allah (peace and blessings of Allah be upon him), and the Messenger of Allah (peace and blessings of Allah be upon him) decreed: "The blood money for her fetus is a male slave or a female slave." And he decreed the blood money for the woman upon her paternal kin (*'aqilah*). Then Hamal ibn Nabighah al-Hudhali said: "How shall I pay a fine for one who did not drink, nor eat, nor speak, nor cry out? Such a case is void." The Prophet (peace and blessings of Allah be upon him) said: "He is only one of the brothers of the soothsayers, because of the rhymed prose he used."
