Musnad Ahmad 30:793

Yazid narrated to us, Ibn Abi Dhi'b informed us, from al-Harith ibn 'Abd al-Rahman, from Abu Salamah, from Abu Hurayrah, who said: The Messenger of Allah (ﷺ) said: "If he becomes intoxicated, then flog him. Then if he becomes intoxicated, then flog him. Then if he returns [to it] a fourth time, then strike his neck [execute him]." Al-Zuhri said: "A man who was intoxicated for the fourth time was brought to the Messenger of Allah (ﷺ), and he let him go."
