Hadith 5:12

Abu Sa’id narrated to us, Isra’il narrated to us, Simak narrated to us, from Hanash, from ‘Ali, who said: The Messenger of Allah (ﷺ) sent me to Yemen. We arrived at a people who had built a pit for a lion. While they were pushing one another, a man fell in, and he clung to another, then a man clung to another, until four of them were in it. The lion wounded them, then a man stood up to it with a spear and killed it, and they all died from their wounds. The guardians of the first man rose up against the guardians of the others, and they drew weapons to fight one another. ‘Ali (may Allah be pleased with him) came to them at that juncture and said: "Do you wish to fight while the Messenger of Allah (ﷺ) is alive? I will judge between you with a judgment; if you are satisfied with it, then it is the judgment, otherwise I will restrain some of you from others until you come to the Prophet (ﷺ) and he is the one who judges between you. Whoever transgresses after that, he has no right." "Collect from the tribes of those who were present at the pit a quarter of the blood money, a third of the blood money, half of the blood money, and the full blood money. For the first is a quarter, because those above him perished; for the second is a third of the blood money; for the third is half of the blood money." They refused to be satisfied, so they came to the Prophet (ﷺ) while he was at the Station of Ibrahim, and they narrated the story to him. He said: "I will judge between you," and he sat with his legs drawn up to his abdomen. A man from the people said: "Indeed, ‘Ali judged among us," and they narrated the story to him, and the Messenger of Allah (ﷺ) approved it.

حدثنا أبو سعيد، حدثنا إسرائيل، حدثنا سماك، عن حنش، عن علي، قال: بعثني رسول الله صلى الله عليه وسلم إلى اليمن، فانتهينا إلى قوم قد بنوا زبية للأسد، فبينا هم كذلك يتدافعون إذ سقط رجل، فتعلق بآخر، ثم تعلق رجل بآخر، حتى صاروا فيها أربعة، فجرحهم الأسد، فانتدب له رجل بحربة فقتله، وماتوا من جراحتهم كلهم، فقام أولياء الأول إلى أولياء الآخر، فأخرجوا السلاح ليقتتلوا، فأتاهم علي رضي الله عنه على تفيئة ذلك، فقال: تريدون أن تقاتلوا ورسول الله صلى الله عليه وسلم حي؟ إني أقضي بينكم قضاء إن رضيتم فهو القضاء، وإلا حجز بعضكم عن بعض حتى تأتوا النبي صلى الله عليه وسلم فيكون هو الذي يقضي بينكم، فمن عدا بعد ذلك فلا حق له، اجمعوا من قبائل الذين حضروا البئر ربع الدية، وثلث الدية ونصف الدية والدية كاملة، فللأول الربع، لأنه هلك من فوقه، وللثاني ثلث الدية، وللثالث نصف الدية فأبوا، أن يرضوا، فأتوا النبي صلى الله عليه وسلم وهو عند مقام إبراهيم، فقصوا عليه القصة، فقال: " أنا أقضي بينكم " واحتبى، فقال: رجل من القوم: إن عليا قضى فينا، فقصوا عليه القصة، فأجازه رسول الله صلى الله عليه وسلم . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .
