Musnad Ali ibn Abi Talib (RA)
مسند علي بن أبي طالب (1) رضي الله عنه
Hadith 5:520
Waki’ narrated to us, [he said] Mis’ar and Sufyan narrated to us, from Abu Husayn, from ‘Umayr ibn Sa’id, who said: Ali said: "I would not have established a prescribed punishment (hadd) upon a man, such that he dies, and then feel [guilt] in my soul regarding it, except for the drinker of wine; for if he had died, I would have paid his blood money." And Sufyan added: "And that is because the Messenger of Allah, peace and blessings of Allah be upon him, did not establish it as a sunnah."
حدثنا وكيع، حدثنا مسعر، وسفيان، عن أبي حصين، عن عمير بن سعيد، قال: قال علي: " ما كنت لأقيم على رجل حدا فيموت، فأجد في نفسي منه إلا صاحب الخمر، فلو مات وديته " وزاد سفيان: " وذلك أن رسول الله صلى الله عليه وسلم لم يسنه "
