Musnad Ahmad 1013:54

I read to ‘Abd al-Rahman: Malik, from Ibn Shihab, and Ishaq ibn ‘Isa narrated to us: Malik informed me, from Ibn Shihab, that Sahl ibn Sa‘d informed him that: ‘Uwaymir al-‘Ajlani came to ‘Asim ibn ‘Adi al-Ansari and said: “O ‘Asim, what do you think of a man who finds a man with his wife? Should he kill him, and then you kill him, or how should he act? Ask the Messenger of Allah (may Allah bless him and grant him peace) about that for me, O ‘Asim.” So ‘Asim asked the Prophet (may Allah bless him and grant him peace) about that. The Messenger of Allah (may Allah bless him and grant him peace) disliked the questions and criticized them, until it became burdensome for ‘Asim to hear what he heard—Ishaq said: what he heard from the Messenger of Allah (may Allah bless him and grant him peace). When ‘Asim returned to his family, ‘Uwaymir came to him and said: “O ‘Asim, what did the Messenger of Allah (may Allah bless him and grant him peace) say to you?” ‘Asim said to ‘Uwaymir: “You have not brought me any good; the Messenger of Allah (may Allah bless him and grant him peace) disliked the question I asked him about.” ‘Uwaymir said: “By Allah, I will not desist until I ask him about it.” So ‘Uwaymir went until he came to the Prophet (may Allah bless him and grant him peace) in the midst of the people and said to the Messenger of Allah (may Allah bless him and grant him peace): “What do you think of a man who finds a man with his wife? Should he kill him, and then you kill him, or how should he act?” The Messenger of Allah (may Allah bless him and grant him peace) said to him: “Allah has revealed [verses] concerning you and your companion, so go and bring her.” Sahl ibn Sa‘d said: So they performed the *li‘an* (oath of condemnation), and I was with the people at the Messenger of Allah (may Allah bless him and grant him peace). When they finished, ‘Uwaymir said: “I have lied against her, O Messenger of Allah, if I keep her.” So he divorced her three times before the Messenger of Allah (may Allah bless him and grant him peace) commanded him to do so.
