Musnad Ahmad 788:173

Aswad ibn Amir narrated to us, Isra'il narrated to us, from Abu Ishaq, from Abu Burdah, from his father, who attributed it to the Prophet (ﷺ), who said: "The orphan girl shall be consulted regarding herself. If she remains silent, then that is her permission. But if she refuses, then she shall not be married."
