Musnad Ahmad 1226:6

Abu Kamil narrated to us, he said: Layth narrated to us, he said: Sa'id ibn Abi Sa'id narrated to me, from Abu Shurayh al-Adawi, that he said to 'Amr ibn Sa'id while he was sending armies to Makkah: "Permit me, O Amir, to relate to you a statement that the Messenger of Allah (peace and blessings of Allah be upon him) stood and delivered the day after the conquest. My ears heard it, my heart grasped it, and my eyes saw him when he spoke it: That he praised Allah and extolled Him, then said: 'Indeed, Makkah was made sacred by Allah, and it was not made sacred by the people. Therefore, it is not lawful for a person who believes in Allah and the Last Day to shed blood therein, nor to cut down a tree therein. If anyone seeks a concession [to fight] by the fighting of the Messenger of Allah (peace and blessings of Allah be upon him) therein, then say: Indeed, Allah (Mighty and Majestic is He) permitted His Messenger, but He did not permit you. And He only permitted it for me for an hour of a day, and its sanctity has returned today just as its sanctity was yesterday. So let the witness inform the absent.'" It was said to Abu Shurayh: "What did 'Amr say to you?" He said: "He said: 'I know that better than you, O Abu Shurayh. Indeed, the Sanctuary does not protect a sinner, nor one fleeing from blood, nor one fleeing from jizyah.'" Hajjaj said: "from jizyah," and Ya'qub said, from his father, from Ibn Ishaq: "nor one who withholds jizyah."
