Hadith of Abu Shurayh al-Khuza'i (RA)
حديث أبي شريح الخزاعي
Hadith 308:8
Ya'qub narrated to us, he said: My father narrated to us, from Ibn Ishaq, he said: Sa'id ibn Abi Sa'id al-Maqburi narrated to me, from Abu Shurayh al-Khuza'i, he said: When 'Amr ibn Sa'id sent [an army] to Makkah, he sent it to fight Ibn al-Zubayr. Abu Shurayh came to him and spoke to him, and informed him of what he had heard from the Messenger of Allah (may Allah bless him and grant him peace). Then he went out to the gathering place of his people and sat in it. I stood up to him and sat with him, and he narrated to his people just as he had narrated to 'Amr ibn Sa'id regarding what he had heard from the Messenger of Allah (may Allah bless him and grant him peace) and what 'Amr ibn Sa'id had said to him. He said: I said, "O man, we were with the Messenger of Allah (may Allah bless him and grant him peace) when he conquered Makkah. When the day after the conquest came, the tribe of Khuza'ah attacked a man from Hudhayl and killed him while he was a polytheist. The Messenger of Allah (may Allah bless him and grant him peace) stood among us as a preacher and said: 'O people, Allah the Almighty made Makkah sacred the day He created the heavens and the earth. So it is sacred by the sanctity of Allah the Almighty until the Day of Resurrection. It is not lawful for a person who believes in Allah and the Last Day to shed blood in it, nor to cut down its trees. It was not made lawful for anyone before me, nor will it be made lawful for anyone after me. And it was not made lawful for me except for this hour, out of anger against its people. Behold, it has returned to its sanctity as it was yesterday. Behold, let those of you who are present inform those who are absent. If anyone says to you that the Messenger of Allah (may Allah bless him and grant him peace) fought in it, then say: Indeed, Allah the Almighty made it lawful for His Messenger and did not make it lawful for you. O company of Khuza'ah, withdraw your hands from killing, for it has occurred too much. If you kill a person, I will pay the blood money for him. Whoever is killed after this standing of mine, his family has the best of two choices: if they wish, they may have the blood of the killer, and if they wish, they may have the blood money.'" Then the Messenger of Allah (may Allah bless him and grant him peace) paid the blood money for the man whom Khuza'ah had killed. 'Amr ibn Sa'id said to Abu Shurayh: "Go away, O old man, for we know more about its sanctity than you do. It does not protect a shedder of blood, nor one who breaks obedience, nor one who withholds tribute." He said: I said, "I was present and you were absent, and I have conveyed [the message]. The Messenger of Allah (may Allah bless him and grant him peace) commanded us that those of us who are present should convey it to those who are absent. I have conveyed it to you, so it is your affair."
حدثنا يعقوب، قال: حدثنا أبي، عن ابن إسحاق قال: حدثني سعيد بن أبي سعيد المقبري، عن أبي شريح الخزاعي قال: لما بعث عمرو بن سعيد إلى مكة بعثه يغزو ابن الزبير، أتاه أبو شريح فكلمه وأخبره بما سمع من رسول الله صلى الله عليه وسلم، ثم خرج إلى نادي قومه فجلس فيه، فقمت إليه فجلست معه، فحدث قومه كما حدث عمرو بن سعيد ما سمع من رسول الله صلى الله عليه وسلم وعما قال له عمرو بن سعيد، قال: قلت: يا هذا إنا كنا مع رسول الله صلى الله عليه وسلم حين افتتح مكة فلما كان الغد من يوم الفتح عدت خزاعة على رجل من هذيل فقتلوه وهو مشرك، فقام رسول الله صلى الله عليه وسلم فينا خطيبا فقال: " أيها الناس، إن الله عز وجل حرم مكة يوم خلق السماوات والأرض، فهي حرام من حرام الله تعالى إلى يوم القيامة، لا يحل لامرئ يؤمن بالله واليوم الآخر أن يسفك فيها دما، ولا يعضد بها شجرا، لم تحلل لأحد كان قبلي، ولا تحل لأحد يكون بعدي، ولم تحلل لي إلا هذه الساعة غضبا على أهلها، ألا ثم قد رجعت كحرمتها بالأمس، ألا فليبلغ الشاهد منكم الغائب، فمن قال لكم إن رسول الله صلى الله عليه وسلم قد قاتل بها فقولوا: إن الله عز وجل قد أحلها لرسوله ولم يحللها لكم، يا معشر خزاعة، ارفعوا أيديكم عن القتل، فقد كثر أن يقع، لئن قتلتم قتيلا لأدينه، فمن قتل بعد مقامي هذا فأهله بخير النظرين، إن شاءوا فدم قاتله وإن شاءوا فعقله "، ثم ودى رسول الله صلى الله عليه وسلم الرجل الذي قتلته خزاعة فقال عمرو بن سعيد لأبي شريح: انصرف أيها الشيخ، فنحن أعلم بحرمتها منك، إنها لا تمنع سافك دم، ولا خالع طاعة ولا مانع جزية، قال: فقلت: قد كنت شاهدا، وكنت غائبا فقد بلغت، وقد أمرنا رسول الله صلى الله عليه وسلم أن يبلغ شاهدنا غائبنا، وقد بلغتك فأنت وشأنك
