حديث البراء بن عازب
Hadith 658:58
Abu Mu’awiyah narrated to us, Al-A’mash narrated to us, from ‘Abdullah ibn Murrah, from Al-Bara’ ibn ‘Azib, who said: A Jew passed by the Messenger of Allah, peace and blessings of Allah be upon him, having been blackened [with soot] and whipped. He called them and said: "Is this how you find the punishment for the adulterer in your Book?" They said: "Yes." He said: So he called a man from among their scholars and said: "I adjure you by Allah who revealed the Torah to Moses, is this how you find the punishment for the adulterer in your Book?" He said: "No, by Allah. Were it not that you adjured me by this, I would not have told you. We find the punishment for the adulterer in our Book to be stoning, but it became frequent among our nobles. So, when we caught a noble, we would leave him, and when we caught a weak person, we would carry out the punishment upon him. We said: 'Come, let us establish something that we can carry out upon the noble and the lowly.' So we agreed upon blackening [with soot] and whipping." The Messenger of Allah, peace and blessings of Allah be upon him, said: "O Allah, I am the first to revive Your command when they had caused it to die." He said: So he ordered him, and he was stoned. Then Allah, the Almighty and Majestic, revealed: "O Messenger, let not those who hasten into disbelief grieve you" [Al-Ma'idah: 41] up to His saying: "Saying, 'If you are given this, take it'" [Al-Ma'idah: 41]. They say: "Go to Muhammad; if he gives you a fatwa for blackening and whipping, take it, and if he gives you a fatwa for stoning, then beware." Up to His saying: "And whoever does not judge by what Allah has revealed - then it is those who are the disbelievers" [Al-Ma'idah: 44]. He said regarding the Jews, up to His saying: "And whoever does not judge by what Allah has revealed - then it is those who are the wrongdoers" [Al-Ma'idah: 45], "And whoever does not judge by what Allah has revealed - then it is those who are the defiantly disobedient" [Al-Ma'idah: 47]. He said: "All of them are regarding the disbelievers."
حدثنا أبو معاوية، حدثنا الأعمش، عن عبد الله بن مرة، عن البراء بن عازب، قال: مر على رسول الله صلى الله عليه وسلم، بيهودي محمم مجلود، فدعاهم، فقال: " أهكذا تجدون حد الزاني في كتابكم؟ " فقالوا: نعم. قال: فدعا رجلا من علمائهم، فقال: " أنشدك بالله الذي أنزل التوراة على موسى، أهكذا تجدون حد الزاني في كتابكم؟ " فقال: لا والله، ولولا أنك أنشدتني بهذا لم أخبرك، نجد حد الزاني في كتابنا الرجم، ولكنه كثر في أشرافنا، فكنا إذا أخذنا الشريف، تركناه، وإذا أخذنا الضعيف، أقمنا عليه الحد، فقلنا: تعالوا حتى نجعل شيئا نقيمه على الشريف والوضيع، فاجتمعنا على التحميم والجلد، فقال رسول الله صلى الله عليه وسلم: " اللهم إني أول من أحيا أمرك إذ أماتوه " قال: فأمر به فرجم، فأنزل الله عز وجل: {يا أيها الرسول لا يحزنك الذين يسارعون في الكفر} [المائدة: 41] إلى قوله: {يقولون إن أوتيتم هذا فخذوه} [المائدة: 41] يقولون: ائتوا محمدا فإن أفتاكم بالتحميم، والجلد، فخذوه، وإن أفتاكم بالرجم، فاحذروا، إلى قوله: {ومن لم يحكم بما أنزل الله فأولئك هم الكافرون} [المائدة: 44] قال في اليهود إلى قوله: {ومن لم يحكم بما أنزل الله فأولئك هم الظالمون} [المائدة: 45] ، {ومن لم يحكم بما أنزل الله فأولئك هم الفاسقون} [المائدة: 47] قال: " هي في الكفار كلها "
