Hadith of Al-Miswar bin Makhramah Az-Zuhri and Marwan bin Al-Hakam (RA)

حديث المسور بن مخرمة الزهري، ومروان بن الحكم

Hadith 695:8

Ya'qub narrated to us, Ibn Akhi Ibn Shihab narrated to us, from his uncle, who said: Urwah ibn al-Zubayr claimed that Marwan and al-Miswar ibn Makhramah informed him that the Messenger of Allah (may Allah bless him and grant him peace) stood up when the delegation of Hawazin came to him as Muslims. They asked him to return their wealth and their captives to them. The Messenger of Allah (may Allah bless him and grant him peace) said to them: "With me are those whom you see, and the most beloved of speech to me is the most truthful of it. So choose one of the two groups: either the captives or the wealth. I had indeed waited for you." The Messenger of Allah (may Allah bless him and grant him peace) had delayed them for ten-odd nights when he returned from Ta'if. When it became clear to them that the Messenger of Allah (may Allah bless him and grant him peace) would not return to them anything except one of the two groups, they said: "We choose our captives." The Messenger of Allah (may Allah bless him and grant him peace) stood among the Muslims and praised Allah (Mighty and Majestic is He) as He deserves, then said: "To proceed: your brothers have come repentant, and I have decided to return their captives to them. Whoever among you likes to consent to that, let him do so. And whoever among you likes to keep his share until we give it to him from the first [spoils] that Allah (Mighty and Majestic is He) grants us, let him do so." The people said: "We have consented to that for the Messenger of Allah (may Allah bless him and grant him peace)." The Messenger of Allah (may Allah bless him and grant him peace) said to them: "We do not know who among you has permitted this and who has not permitted it. So return, until your leaders report your matter to us." The people gathered, and their leaders spoke to them. Then they returned to the Messenger of Allah (may Allah bless him and grant him peace) and informed him that they had consented and given permission. This is what reached me regarding the captives of Hawazin.

حدثنا يعقوب، حدثنا ابن أخي ابن شهاب، عن عمه، قال: وزعم عروة بن الزبير، أن مروان، والمسور بن مخرمة أخبراه، أن رسول الله صلى الله عليه وسلم قام حين جاءه وفد هوازن مسلمين، فسألوا أن يرد إليهم أموالهم وسبيهم، فقال لهم رسول الله صلى الله عليه وسلم: " معي من ترون، وأحب الحديث إلي أصدقه، فاختاروا إحدى الطائفتين: إما السبي وإما المال، وقد كنت استأنيت بكم " وكان أنظرهم رسول الله صلى الله عليه وسلم بضع عشرة ليلة حين قفل من الطائف، فلما تبين لهم أن رسول الله صلى الله عليه وسلم غير راد إليهم إلا إحدى الطائفتين، قالوا: فإنا نختار سبينا. فقام رسول الله صلى الله عليه وسلم في المسلمين فأثنى على الله عز وجل بما هو أهله، ثم قال: " أما بعد فإن إخوانكم قد جاءوا تائبين، وإني قد رأيت أن أرد إليهم سبيهم، فمن أحب منكم أن يطيب ذلك، فليفعل، ومن أحب منكم أن يكون على حظه حتى نعطيه إياه من أول ما يفيء الله عز وجل علينا، فليفعل " فقال الناس: قد طيبنا ذلك لرسول الله صلى الله عليه وسلم، فقال لهم رسول الله صلى الله عليه وسلم: " إنا لا ندري من أذن منكم في ذلك، ممن لم يأذن، فارجعوا حتى يرفع إلينا عرفاؤكم أمركم " فجمع الناس فكلمهم عرفاؤهم، ثم رجعوا إلى رسول الله صلى الله عليه وسلم، فأخبروه أنهم قد طيبوا وأذنوا هذا الذي بلغني عن سبي هوازن
