Hadith of al-Mughirah ibn Shu‘bah (RA)

حديث المغيرة بن شعبة

Hadith 626:16

'Affan narrated to us, Shu'bah narrated to us, he said: Mansur informed me, he said: I heard Ibrahim narrating from 'Ubayd ibn Nadilah, from al-Mughirah ibn Shu'bah: That two women were under [the marriage of] a man, and they became jealous of one another, so one of them struck the other with a tent pole and killed her. They disputed before the Messenger of Allah, peace and blessings of Allah be upon him. One of them said: "O Messenger of Allah, how shall we pay blood money for one who did not eat, nor drink, nor cry out, and thus [the killing] was considered a crime?" The Prophet, peace and blessings of Allah be upon him, said: "Are you rhyming like the rhyming of the Bedouins?" He said: So he decreed for it a *ghurrah* (a slave, male or female). He said: And he placed it upon the *'aqilah* (the paternal relatives) of the woman.

حدثنا عفان، حدثنا شعبة، قال: منصور أخبرني، قال: سمعت إبراهيم، يحدث عن عبيد بن نضيلة، عن المغيرة بن شعبة: أن امرأتين كانتا تحت رجل، فغارتا فضربتها بعمود فسطاط، فقتلتها، فاختصموا إلى رسول الله صلى الله عليه وسلم، فقال أحدهما: يا رسول الله، كيف ندي من لا أكل، ولا شرب، ولا صاح، فاستهل؟، فقال النبي صلى الله عليه وسلم: " أسجع كسجع الأعراب؟ " قال: فقضى فيه غرة، قال: وجعله على عاقلة المرأة
