Hadith 790:30
Muhammad ibn Ja‘far narrated to us, Sa‘id narrated to us, from Qatadah, from al-Hasan, that Hayyaj ibn ‘Imran came to ‘Imran ibn Husayn and said: "My father has made a vow that if he is able to capture his slave, he will cut off a piece of him or he will cut off his hand." He said: "Tell your father to offer an expiation for his oath and not to cut off a piece of him; for the Messenger of Allah (peace and blessings of Allah be upon him) used to encourage charity in his sermon and forbid mutilation." Then he came to Samurah ibn Jundub and said the same thing to him.
حدثنا محمد بن جعفر، حدثنا سعيد، عن قتادة، عن الحسن، أن هياج بن عمران، أتى عمران بن حصين فقال: إن أبي قد نذر لئن قدر على غلامه ليقطعن منه طابقا أو ليقطعن يده. فقال: قل لأبيك: يكفر عن يمينه، ولا يقطع منه طابقا؛ فإن رسول الله صلى الله عليه وسلم كان " يحث في خطبته على الصدقة، وينهى عن المثلة " ثم أتى سمرة بن جندب فقال له: مثل ذلك
