Hadith 179:15
Muhammad ibn Ja'far narrated to us, he said: Shu'bah narrated to us, from Mansur, he said: I heard Mujahid narrating from Usayd ibn Zuhayr, he said: When one of us had no need for his land, or was in need of it, he would give it [to be cultivated] for a half, a third, or a quarter [of the produce], and he would stipulate the three water channels, the border, and what the spring rain watered. We used to work on it with hard labor and obtain benefit from it. Then Rafi' ibn Khadij came to us and said: The Messenger of Allah (ﷺ) forbade a matter that was beneficial to you, and obedience to Allah and obedience to the Messenger of Allah (ﷺ) is better for you. He forbade you from *al-haql* (sharecropping), and he said: "Whoever has land, let him grant it [to his brother] or let him leave it [fallow]." And he forbade us from *al-muzabanah*. *Al-muzabanah* is when a man has a great amount of palm trees, and a man comes and takes them for such and such *wasaq* (loads) of dates.
حدثنا محمد بن جعفر، قال: حدثنا شعبة، عن منصور، قال: سمعت مجاهدا، يحدث عن أسيد بن ظهير، قال: كان أحدنا إذا استغنى عن أرضه، أو افتقر إليها أعطاها بالنصف، والثلث، والربع، ويشترط ثلاث جداول، والقصارة، وما سقى الربيع، وكنا نعمل فيها عملا شديدا، ونصيب منها منفعا ، فأتانا رافع بن خديج فقال: نهى رسول الله صلى الله عليه وسلم عن أمر كان لكم نافعا، وطاعة الله وطاعة رسول الله صلى الله عليه وسلم خير لكم نهاكم عن الحقل، وقال: " من كانت له أرض فليمنحها أو ليدعها "، ونهانا عن المزابنة، والمزابنة: الرجل يكون له المال العظيم من النخل، فيجيء الرجل، فيأخذها بكذا وكذا وسقا من تمر
