Hadith of Ya‘la ibn Umayyah (RA)

حديث يعلى بن أمية

Hadith 586:6

Ya'qub narrated to us, my father narrated to us, from Ibn Ishaq, who said: 'Ata' ibn Abi Rabah narrated to me, from Safwan ibn 'Abdullah ibn Safwan, from his two paternal uncles, Ya'la ibn Umayyah and Salamah ibn Umayyah, who said: We went out with the Messenger of Allah, peace and blessings of Allah be upon him, on the expedition of Tabuk. We had a companion with us, and he and a man from the Muslims fought. That man bit his forearm, so he pulled his hand away from his mouth, and [the man's] front tooth fell out. The man went to the Messenger of Allah, peace and blessings of Allah be upon him, asking him for the blood money (diya). The Messenger of Allah, peace and blessings of Allah be upon him, said: "Does one of you go to his brother and bite him like a stallion bites, then come seeking blood money? There is no blood money for you." He said: So the Messenger of Allah, peace and blessings of Allah be upon him, invalidated it—meaning he declared it void.

حدثنا يعقوب، حدثنا أبي، عن ابن إسحاق، قال: حدثني عطاء بن أبي رباح، عن صفوان بن عبد الله بن صفوان، عن عميه يعلى بن أمية، وسلمة بن أمية، قالا: خرجنا مع رسول الله صلى الله عليه وسلم في غزوة تبوك، معنا صاحب لنا فاقتتل هو ورجل من المسلمين، فعض ذلك الرجل بذراعه، فاجتبذ يده من فيه فطرح ثنيته، فذهب الرجل إلى رسول الله صلى الله عليه وسلم يسأله العقل، فقال رسول الله صلى الله عليه وسلم: " ينطلق أحدكم إلى أخيه يعضه عضيض الفحل، ثم يأتي يلتمس العقل، لا دية لك " قال: فأطلها رسول الله صلى الله عليه وسلم - يعني فأبطلها -
