Musnad Ahmad 268:3

Haytham narrated to us, he said: Abd Rabbih ibn Maymun al-Ash'ari narrated to us, from al-'Ala' ibn al-Harith, from Makhul, who attributed it to the Prophet (marfu'), he said: "Whichever tree provides shade for a people, its owner has the choice: either to cut what it shades, or to eat its fruit."
