Musnad Ahmad 2:267

Isma'il narrated to us, Ayyub narrated to us, from 'Ikrimah ibn Khalid, from Malik ibn Aws ibn al-Hadthan, who said: Al-'Abbas and 'Ali came to 'Umar, disputing with one another. Al-'Abbas said: "Judge between me and this [man], such and such." The people said: "Decide between them, decide between them." He said: "I will not decide between them. They both know that the Messenger of Allah (peace and blessings of Allah be upon him) said: 'We are not inherited from; whatever we leave is charity.'"
