Hadith 3:27

'Abd al-Razzaq narrated to us, Ma'mar narrated to us, from al-Zuhri, from Malik ibn Aws ibn al-Hadathan, who said: 'Umar ibn al-Khattab sent for me. While I was thus, his freedman Yarfa' came to him and said: "This is 'Uthman, 'Abd al-Rahman, Sa'd, and al-Zubayr ibn al-'Awwam—he said: And I do not know if he mentioned Talhah or not—seeking your permission." He said: "Give them permission." Then he remained for a while, then he came and said: "This is al-'Abbas and 'Ali seeking your permission." He said: "Give them permission." When al-'Abbas entered, he said: "O Commander of the Faithful, judge between me and this one." They were at that time disputing over what Allah had bestowed upon His Messenger from the wealth of Banu al-Nadir. The people said: "Judge between them, O Commander of the Faithful, and relieve each one of them from the other, for their dispute has lasted long." 'Umar said: "I adjure you by Allah, by whose permission the heavens and the earth stand, do you know that the Messenger of Allah, peace and blessings of Allah be upon him, said: 'We are not inherited from; what we leave is charity'?" They said: "He did say that." And he said the same to the two of them, and they said: "Yes." He said: "Then I will inform you about this *fay'* (spoils). Allah, the Mighty and Majestic, singled out His Prophet, peace and blessings of Allah be upon him, with something from it that He did not give to anyone else, for He said: {And what Allah restored to His Messenger from them - you did not spur for it any horses or camels} [Al-Hashr: 6]. It was exclusively for the Messenger of Allah, peace and blessings of Allah be upon him. By Allah, he did not hoard it away from you, nor did he prefer himself over you with it. He divided it among you and distributed it among you, until this wealth remained from it. He used to spend on his family from it for a year, then he would place what remained of it as the wealth of Allah." "When the Messenger of Allah, peace and blessings of Allah be upon him, was taken, Abu Bakr said: 'I am the successor of the Messenger of Allah, peace and blessings of Allah be upon him, after him; I will act regarding it as the Messenger of Allah, peace and blessings of Allah be upon him, used to act regarding it.'"

حدثنا عبد الرزاق، حدثنا معمر، عن الزهري، عن مالك بن أوس بن الحدثان، قال: أرسل إلي عمر بن الخطاب، فبينما أنا كذلك، إذ جاءه مولاه يرفأ، فقال: هذا عثمان وعبد الرحمن وسعد والزبير بن العوام - قال: ولا أدري أذكر طلحة أم لا - يستأذنون عليك. قال: ائذن لهم. ثم مكث ساعة ثم جاء، فقال: هذا العباس وعلي يستأذنان عليك. قال: ائذن لهما. فلما دخل العباس، قال: يا أمير المؤمنين، اقض بيني وبين هذا. وهما حينئذ يختصمان فيما أفاء الله على رسوله من أموال بني النضير، فقال القوم: اقض بينهما يا أمير المؤمنين، وأرح كل واحد من صاحبه، فقد طالت خصومتهما. فقال عمر: أنشدكم الله الذي بإذنه تقوم السماوات والأرض، أتعلمون أن رسول الله صلى الله عليه وسلم قال: " لا نورث، ما تركنا صدقة "؟ قالوا: قد قال ذلك. وقال لهما مثل ذلك، فقالا: نعم. قال: فإني سأخبركم عن هذا الفيء، إن الله عز وجل خص نبيه صلى الله عليه وسلم منه بشيء لم يعطه غيره، فقال: {وما أفاء الله على رسوله منهم فما أوجفتم عليه من خيل ولا ركاب} [الحشر: 6] ، وكانت لرسول الله صلى الله عليه وسلم خاصة، والله ما احتازها دونكم، ولا استأثرها عليكم، لقد قسمها بينكم وبثها فيكم، حتى بقي منها هذا المال، فكان ينفق على أهله منه سنة، ثم يجعل ما بقي منه مجعل مال الله، فلما قبض رسول الله صلى الله عليه وسلم، قال أبو بكر: أنا ولي رسول الله صلى الله عليه وسلم بعده، أعمل فيها بما كان يعمل رسول الله صلى الله عليه وسلم فيها .
